2023-24 Updates

Commission language and other revisions to listings and buyer agency

The Real Estate Examining Board recently approved revisions adding commission transparency language like that featured in Addendum C, revisions to Dispute Resolution provisions and adding the Wire Fraud Warning if not already in the form to the followings listing contracts and buyer agency agreements:

  • WB-1 — Residential Listing Contract — Exclusive Right to Sell
  • WB-2 — Farm Listing Contract — Exclusive Right to Sell
  • WB-3 — Vacant Land Listing Contract — Exclusive Right to Sell
  • WB-4 — Residential Condominium Listing Contract — Exclusive Right to Sell
  • WB-5 — Commercial Listing Contract — Exclusive Right to Sell
  • WB-6 — Business Listing Contract — Exclusive Right to Sell
  • WB-36 — Buyer Agency Agreement
  • WB-37 — Residential Listing Contract — Exclusive Right to Rent
  • WB-38 — Commercial Buyer Agency/Tenant Representation Agreement
  • WB-39 — Tenant Representation Agreement 

The optional use date is December 1, 2023, and the mandatory use date is January 1, 2024. Educational use versions of these forms are available on the DSPS website.

Wire fraud warning added to offers: October 2023

The Real Estate Examining Board recently approved revisions to the offers to purchase, adding the Wire Fraud Warning to the following forms: 

  • WB-11 — Residential Offer to Purchase
  • WB-12 — Farm Offer to Purchase
  • WB-13 — Vacant Land Offer to Purchase
  • WB-14 — Residential Condominium Offer to Purchase
  • WB-15 — Commercial Offer to Purchase
  • WB-16 — Offer to Purchase — Business With Real Estate
  • WB-17 — Offer to Purchase — Business Without Real Estate
  • WB-24 — Option to Purchase

The Wire Fraud Warning is discussed on pages 5-7 of the July 2023 Legal Update, “Separation of Buyer Agency and Tenant Representation,” and in “The Buyer Agency Agreement Is Shrinking!” in the June 2023 Wisconsin Real Estate Magazine

  • WB-47 — Amendment to Buyer Agency or Tenant Representation Agreement was also revised to correct the names the of documents referenced.

The optional use date for all of these revised forms is October 1, 2023, and the mandatory use date is January 1, 2024.

New WRA Addendum C

Addendum C is a new WRA form to be used with listings and buyer agency to enhance commission transparency and assist licensees in explaining to consumers how commissions are determined and paid.

WB-36, WB-39

The Real Estate Examining Board approved revisions to the WB-36 Buyer Agency Agreement and the creation of a new form, the WB-39 Tenant Representation Agreement. The optional use date for each form is July 1, 2023, and the mandatory use date is September 1, 2023.

2021 Updates

WB-16, WB-17, WB-25, WB-46

In September 2021, the Real Estate Examining Board approved updated versions of the WB-16 Offer to Purchase — Business With Real Estate and the WB-17 Offer to Purchase — Business Without Real Estate along with revised versions of the WB-25 Bill of Sale and the WB-46 Multiple Counter-Proposal.

In October 2020, the Real Estate Examining Board approved a new version of the WB-13 Vacant Land Offer to Purchase form and the WB-15 Commercial Offer to Purchase.

The Real Estate Examining Board approved a new version of the WB-12 Farm Offer to Purchase with an optional use date of April 1, 2021, and a mandatory use date of May 1, 2021.

      2020 Updates

      WB-11 "Take 2" and WB-14 Changes

      In June 2020, the Real Estate Examining Board approved a new version of the WB-11 Residential Offer to Purchase form and the WB-14 Residential Condominium Offer to Purchase. Given this is the second WB-11 Residential Offer to Purchase released in 2020, the form will be referred to as WB-11 "Take 2." Both forms have the same optional use and mandatory use dates of August 1, 2020, and September 1, 2020, respectively.

      How are the new forms developed?

      The WB forms are prepared and approved for use by the REEB. Prior to approval, drafts are reviewed by the Wisconsin REALTORS® Association forms committee, chaired by REALTOR® Tom Sykora, and comments are forwarded on to the DSPS real estate contractual forms advisory committee. Once the DSPS state forms are finalized, WRA-drafted forms are examined to see if changes are warranted.
