WRA Legislative Alert: Housing Affordability Bill Passes in Wisconsin Legislature

The WRA supported AB 770, designed to make housing more affordable by addressing local fees, requiring audits of local government regulations, and incentivizing higher density development.

AB 770/SB 640 overview

  • Impact fees: Modifies local impact fee requirements to provide more flexible methods of impact fee payments and also closes procedural loopholes related to park fees.
  • Housing affordability reports: Requires municipalities over 10,000 people to identify all fees and regulations imposed on new residential development to better understand how these fees and regulations impact housing affordability.
  • Inclusionary zoning: Prohibit local communities from adopting inclusionary zoning (IZ) ordinances, which require a certain percentage of new housing units to be “affordable.” IZ requirements distort the marketplace and were found unconstitutional by the Wisconsin Supreme Court.
  • Workforce housing incentive: Provide financial incentives for municipalities to provide more workforce housing through increased density.

This bill is awaiting Gov. Walker's signature.
